Del. Work Comp Reform, Can it Be?

A "little bird" told me that the Governor's taks force assigned to look into a legislative measure to control Delawares wcomp rates, will be putting forward a bill for reform before the end of November. We certainly need it, since most small businesses have a hard time paying the premiums for work comp. Also Pa. & Md have rates significantly lower which does not help when competitiors come into the State and steal Delaware business. Let's keep our fingers crossed for small business sake. K

In the past I have spoken to clients regarding a particular workers compensation claim affecting them and have asked if they have brought the employee back to work yet. Too many times the answer is no, they have nothing for that employee to do since said employee is not 100% and unable to perform their specific job prior to their workers compensation injury/claim. The problem with this is that too often employers miss the point that even though an employee can't perform in the position they were in prior to their injury, it behooves the employer to create some type of alternative task/job the employee can do until such time they are able to resume their normal duties. Bringing that employee back to work means that work comp benefits /payments in that particular claim are being curtailed, thereby saving the employer potentially more being paid out, while adding to their experience mod and driving their overall work comp expenses up.

Delaware Business Insurance Update from CNC Insurance Associates, "Please Read Your Contracts" 3-31-14

Most business owners will sign contracts in the course of business, but will never read them. When problems arise however then the terms in the contract are discovered and usually they are not good for the business owner. Today's contracts are very much loaded in favor of the lessor, the one that lets the contract. The business owner who signs them does not realize that all the terms go against them until it is too late.  Make sure you read every contract before you sign. Understand who is responsible for damages and watch words like "hold harmless" and  "indemnification".
