Del. Work Comp Reform, Can it Be?

A "little bird" told me that the Governor's taks force assigned to look into a legislative measure to control Delawares wcomp rates, will be putting forward a bill for reform before the end of November. We certainly need it, since most small businesses have a hard time paying the premiums for work comp. Also Pa. & Md have rates significantly lower which does not help when competitiors come into the State and steal Delaware business. Let's keep our fingers crossed for small business sake. K

In the past I have spoken to clients regarding a particular workers compensation claim affecting them and have asked if they have brought the employee back to work yet. Too many times the answer is no, they have nothing for that employee to do since said employee is not 100% and unable to perform their specific job prior to their workers compensation injury/claim. The problem with this is that too often employers miss the point that even though an employee can't perform in the position they were in prior to their injury, it behooves the employer to create some type of alternative task/job the employee can do until such time they are able to resume their normal duties. Bringing that employee back to work means that work comp benefits /payments in that particular claim are being curtailed, thereby saving the employer potentially more being paid out, while adding to their experience mod and driving their overall work comp expenses up.

Insurance industry watch out, here comes Peer To Peer insurance sharing and it could revolutionize the industry. What is this about?  Well a couple of pioneer investors are looking to create and implement an insurance company where people can share in the risks and bypass the big insurance companies. The mechanism is not published yet but it looks a lot like peer to peer funding. The difference is that the risk takers can make money if there are no claims on their risks. Insurance regulators are looking hard at the model and I am sure there will be some push back. However consumers see this as a way to shake up the experience of insurance and change the industry. Many business owners allow some personal use of company vehicles by employees. Mostly this is for minor business type activities after hours, emergencies, or general accommodations. However in the age of big data, business owners are getting a wake up call.  A quick review of an employee motor vehicle record (MVR), an employer can assess if  fines, accidents, or other violations were after hours in a company vehicle. What is being revealed is that employees are driving a lot more with business autos, than was even expected.
